Overview An employer is under a legal duty to give each new employee information about his Disciplinary Procedures in the written Statement of Particulars or Contract of Employment. It is now well established that an employee should not be disciplined or dismissed until a proper Disciplinary Procedure has been followed. This will almost certainly involve holding a formal disciplinary hearing into any complaints or allegations made against an employee, before any disciplinary decision is taken. It is essential therefore that every company has a well publicised Disciplinary Procedure, and that it conforms to the recommendations of the ACAS Code of Practice on Disciplinary and Grievance Procedures (issued in September 2000). The need for proper Disciplinary Procedures cannot be stressed too often.
