Overview An employer with 20 or more employees is required to advise his employee about any Disciplinary Rules that apply to their employment. Employers with fewer than 20 employees must not be coaxed into believing that they are exempt from the need to have Disciplinary Rules on account of this quirk in the law. No. Its just that they do not have to notify their staff about them in the Statement of Particulars or Contract of Employment. How confusing! Moreover the ACAS Code of Practice on Disciplinary and Grievance Procedures (Sept 2000 edition) obliges ALL employers to comply with the Code's recommendations when drawing up Disciplinary Rules, Disciplinary Procedures and Grievance Procedures. If an employee is dismissed for an alleged breach of a rule, an Employment Tribunal will almost certainly want confirmation that the rule was brought to the attention of the employee and that a proper Disciplinary Procedure was followed throughout the disciplinary process. It is important too that Disciplinary Rules are relevant to the company's operational and business needs. Most businesses have peculiarities and requirement that are particular to them and these need to be reflected in the rules.
