Statements of Particulars

Overview
Under the Employment Rights Act 1996, an employer
is legally obliged to issue each new employee with
written  
details about their main terms and conditions of employment.
These written details are officially called a Statement of Particulars.

The Statement must give the specific information itemised in the Act, and be issued within strict time limits and in a prescribed form.

An employee who has not received a Statement of Particulars may complain to an Employment Tribunal.

Technically a Statement of Particulars is not a Contract of Employment, although it is frequently referred to as such. Rather it is persuasive evidence of some core terms and conditions that a contract of employment would contain if one were issued.

An employer wishing to issue staff with a more comprehensive set of terms and conditions of employment than those specified in the Statement, would normally issue a Contract of Employment or Staff Handbook, and incorporate the Statement within it.

Statements of Particulars are important documents, since they regulate the formal legal relationship between the company and its employees. It is therefore vital to the interests of both parties that Statements of Particulars are drawn up with great care and attention to detail.
